Understanding IP (Intellectual Property)

People often misuse the concept of ‘Intellectual Property (IP)’ and indicate that something is ‘their’ IP when it isn’t. Here is some clarity as to what this term means and when it can be used 💡

To whom does the IP belong?

The person that thought it up, or put the work into creating it that then secures it, holds the rights to it. They register it by either Patenting, Copyrighting or Trademarking it.

These inventors and creators that have registered it get to decide:

  • Who makes it
  • How & where it gets to be used
  • Who can sell and profit from it

How can innovators keep their IP safe from misuse by others?

  • There are 4 major paths to legal protection:
    🔐 Applying for a Patent (inventions, new processes, new machines, new ways of manufacturing)


©️ Applying for Copyright (art, music, writings, movies, and software)


™️ Using a Trademark to cover unique names and identifiers (business names, logos, slogans, mascots, etc.)


🤐Secrecy Agreement (such as confidentiality agreements and non-circumvention agreements, etc.) 

Just because someone has the ‘know-how’ about something, doesn’t mean that they hold the rights to it, a person only owns it when they have successfully registered it as an individual or company, and made that invention ‘proprietary’.

This is very good to know for all creators and inventors and to ensure your ideas, and the ideas of others are protected.
